Does anyone know if Radio 3 are planning to podcast the weekly Choral Evensong and/or Early Music Show programs? These seem consistently to be the most downloaded shows on the BBC Radio Player's 'Listen Again' service. I'm suspecting that there may be 'rights' issues with such programmess but it would be good to know either way! Thanks in advance for any information from anyone.

Hi nick, welcome.

I think that in some ways you've already answered the question; that the issue of rights and performance fees is likely to be a stumbling block for the time being, certainly with EMS, which uses commercial CDs as part of its material, and wasn't there an archive CE fairly recently which was taken from CD, too? Bearing in mind that R3's archives in general have created something of an issue regarding the plans for programme on demand, I'd guess it's likely that until that whole question is sorted out, podcasts of the majority of R3's music-based broadcasts will remain a dream.

Just in passing, I wonder if you've reached this board believing it to be the official BBC R3 board? The reason why it has r3 in the title is a tad long-winded, but just in case that was what you wanted, you'll need to visit this:

Many thanks for your feedback, Ron. I suppose that this explains why there are so precious few podcasts for this, the most esteemed of all radio stations!

Indeed, there are still ways for one to have Choral Evensong broadcasts et al. on one's mp3 player, although I suspect that the legality of it may be somewhat 'grey'. The way to do it of course is to install an mp3 recorder onto one's PC and then to record the show either as it streams live or via Listen Again. I believe that if it is for personal use, then there is nothing illegal here. After all, we've all being doing this for decades by taping programmes from the radio.

I did realise that this was not the official R3 board but from perusing the comments herein, I soon realised that I would be amongst R3 afficionados who would be highly knowledgeable about all things pertaining to 'The Third Programme'!

In which case I'm even happier that you found us, Nick, and decided to join.

 Recording from the radio for personal use is not illegal, and there are to my certain knowledge several posters here who have been doing so selectively with R3's output for years if not decades. It is quite likely that much of that material no longer exists in the official archives, and in exactly the same way that calls went out for missing episodes of comedy series, it is not altogether impossible that some of the material held privately may, in the future, help to fill the gaps that now exist.

Nick and Ron, while the rights issues have been sorted by the Beeb re. recording broadcasts for personal use, the recording of the Internet streams, whether live or "Listen Again", remains an infringement of copyright. I am given to understand that the Beeb is curently trying to sort out this matter.
