If I remember the news of his arrest correctly, it was last autumn when the incident happened. And the trial was last week.

Can witnesses reliably testify to what happened a year ago? I certainly have no idea of specific dates and times of events in my life last October  Undecided

"Please tell the court what did you do on the evening of the 7th of October 2007."
"I have no idea, m'lud."
If on the other hand someone had broken into your hotel room and acted violently towards you, you might well remember it better, no?

Not saying that's what happened, just that you might remember it if so ...

Surely O.J. Simpson isn't the only person who's ever had to wait several months to stand trial?

Yes, I dare say that is so.

But don't prosecutions often rely on corroborating evidence from people not directly involved, to avoid the case resting on one man's word against another's? The chambermaid who passed the suspects casually in the corridor... who passes thousands of hotel guests, many of them famous faces, every night of her life... can she reliably testify that O.J. was there on that particular night a year ago? (Not saying that's what happened in this case, just that that's the sort of witness I imagine the prosecution would call.)

You'll have given your initial statement rather sooner after events, which probably helps fix things in your mind.

Ah, but then cross-examination becomes futile, the details you gave in the statement being the ones that are fixed in your mind and anything you forgot to say at the time probably now forgotten forever.

In fact, no need to call a witness at all -- just read their statements and accept that they are the most accurate facts you will get.

Not really, IRF.  Surely one of the principal purposes of cross-examination is to invite the witnesses to consider the possibility that at any time, including the time at which they gave their initial statements, they might have misinterpreted what they saw or heard; especially that they might have been predisposed to misinterpret by one or more of a range of factors such as their own prejudices, the specific questions asked (or not asked) by the investigators, prevailing levels of visibility and audibility etc, etc.  Another obvious purpose of cross-examination is to invite the jurors to consider the possibility that the witness is sufficiently confused or dishonest as to be unreliable - so showing that something in their initial statement must have been wrong would probably be highly damaging to the side for which the witness appears.

Not O. J. but since I mentioned the name in an earlier post on this thread, it seems as good a place as any to comment on the deeply disturbing documentary this evening on Phil Spector. Hollywood Babylon, monstrous ego, questionable sanity. And all to a soundtrack of three minute epics of teenage innocence ( apropos of nothing much, I'd take the Ronettes and the Crystals over Imagine era John Lennon any day of the week please ) A glimpse into a very dark place.

What channel was that on?  I'm sorry I missed that.  I've always found him strangely sinister.  Has he been found guilty?

Bobby Z, you must have different timings in England, that documentary has only just finished here.  I never knew Phil Spector produced the Beatles.  A most fascinating programme with great music.

Not guilty verdict Milly, the Judge said it was a mis-trial.
